COPYRIGHT NOTICE

  1. Copyright of all course material, lecture notes, presentations, manuals, recordings and related Intellectual Property (“Course Content”) is the exclusive right of SANDTA under Section 6 of the Copyright Act 1978. All rights reserved according to the Bern Convention and according to the Copyright Act 98 of 1978. SANDTA, as the author, gains moral rights in such work, such as the right to be credited, and these works remain the property of SANDTA during the duration of the author's life plus 50 years.
  2. Any redistribution or reproduction of part or all of the contents in any form is prohibited other than the following:
  3. Any unauthorised use, reproduction, distribution, or adaptation of the Course Content, whether in whole or in part, in any format (including but not limited to physical, electronic, or online), is strictly prohibited;
  4. In particular, the use of Course Content to create, market, or deliver competing training, workshops, or courses is a direct infringement of our intellectual property rights and will not be tolerated.
    • You may copy the content to individual third parties for their personal use, but only if you acknowledge the author and owner as the source of the material.
    • You may not, except with our express written permission, distribute or commercially exploit in whole or in part the content.
    • Nor may you transmit it or store it in any other website or other form of electronic retrieval system.
  5. SANDTA hereby authorises you to copy documents published by SANDTA for internal use or non-commercial use within your organization only as long as all copies clearly acknowledge SANDTA as a source. In consideration of this authorisation, you agree that any copy of these documents which you make shall retain all copyright and other proprietary notices contained herein.
  6. Any individual or organisation found reproducing, selling, distributing, or using Course Content without prior written authorisation from SANDTA will face immediate legal action.
  7. Remedies will include claims for injunctions, damages, legal costs, and, where applicable, criminal prosecution.
  8. Works that are used without proper authorisation will constitute copyright infringement under the Copyright Act. SANDTA expressly reserves the right to pursue all available legal remedies, including but not limited to urgent High Court applications, to prevent and penalise infringement.
  9. Section 23 of the Act makes it clear that a copyright is infringed by any person who is not the owner and uses the works without a license to sell, import, or distribute without the knowledge and authorisation of the owner will be liable to action by the owner under Section 24 of the Act.
  10. This Notice doesn’t restrict any use of this material that is permitted under the Copyright Act. The use of the material for learning or internal purposes is permitted, provided credit is given to SANDTA, but no person may copy, upload, distribute any material publicly or use the content to deliver competing courses or sell the material commercially without written permission from SANDTA.
  11. The Parties consent to the exclusive jurisdiction of the Johannesburg High Court, in South Africa, for any claims arising out of this Notice, whether on a contractual, delictual or statutory nature.
